1. Scope and who we are
These terms and conditions govern yacht and boat charter bookings made through unanocheenlamovida.es, operated under the brand Ibiza charter yachts, based in Ibiza, Spain. They apply to every enquiry, quote and confirmed charter arranged through the site, by email, by phone or via WhatsApp.
Anyone who submits an enquiry or confirms a charter with us accepts these terms in full. For any question about a booking or about these terms, contact [email protected].
2. From enquiry to confirmed booking
Browsing the fleet or sending an enquiry does not reserve a yacht. A charter remains provisional until we have sent a quote in writing covering the yacht, the dates, the number of guests and the price, and the client has confirmed acceptance of that quote in writing and paid the deposit described below. A booking exists from that point and not before.
Enquiries can be made through the website's enquiry form, by email, by phone or via WhatsApp, and all are handled the same way. A quote reflects availability at the time it is sent and does not guarantee that a particular yacht remains free until the deposit is received.
3. Prices and charter inclusions
Prices shown on the website are day rates starting from €2,200 and are indicative; the price that applies to a specific charter is the one stated in the quote sent for that booking. Each quote sets out the charter fee and lists separately any fuel, marina fees, the advance provisioning allowance (APA) on larger yachts, catering and other extras relevant to that charter. Nothing beyond what is stated in the quote is added to the final bill.
- Fuel consumed during the charter is charged as stated in the quote
- Marina and port fees, where they apply, are charged as stated in the quote
- APA, where the yacht requires one, covers running costs such as fuel, food and drink and is settled against receipts
- Catering and any requested extras are charged as stated in the quote
4. Payment and deposit
Day charters are secured with a deposit of 30% of the charter fee; the balance is due before boarding. Multi-day charters are secured with a deposit of 50% of the charter fee at the time of booking, with the balance due 30 days before embarkation.
We do not process payments through the website. Payment is arranged directly with our team once the quote has been accepted, using the details we provide at that stage.
5. Cancellation and changes by the client
Because a charter is a leisure service tied to a specific date, the 14-day right of withdrawal that applies to most distance contracts under EU consumer law does not apply here (Directive 2011/83/EU, Article 16(l); in Spain, Article 103(l) of Royal Legislative Decree 1/2007). Instead, the following voluntary cancellation policy applies to every booking made through unanocheenlamovida.es.
- More than 30 days before departure: full refund minus a 10% handling fee
- Between 14 and 30 days before departure: 50% refund
- Less than 14 days before departure: no refund
One free change of date is allowed per booking, provided it is requested at least 72 hours before departure. Requests to cancel or change a booking should be sent to [email protected].
6. Cancellation or changes by us
If the captain or the relevant port authority considers conditions unsafe for sailing, the charter will not go ahead as planned. In that situation the client is offered a free new date or a full refund, whichever is preferred. The same approach applies if a technical issue with the yacht, or another event beyond our control, prevents the charter from running as booked.
The captain's assessment of safety on the day is final and is not open to negotiation.
7. Guest capacity and safety rules
Every yacht carries a licensed maximum number of guests, stated in the quote, and this figure may never be exceeded for any charter, regardless of the age of those on board. The crew may refuse boarding to any guest whose condition or behaviour would endanger the safety of other guests, the crew or the yacht, and may require a guest already aboard to disembark for the same reason.
Children must be supervised by an adult throughout the charter, and life jackets must be worn whenever the crew instructs it.
8. Captain's authority and itinerary
The captain commands the yacht and everyone on board for the duration of the charter. The itinerary set out in the quote is followed wherever weather, sea conditions, port regulations and the captain's judgement allow, but the captain may shorten, alter or end any part of the route for safety or operational reasons. This does not amount to a failure to deliver the charter as booked.
Any instruction given by the captain or crew for safety reasons must be followed immediately by all guests.
9. Conduct, damage and personal belongings
Guests are expected to behave reasonably and to respect the yacht, the crew and other guests on board. The captain may restrict smoking, diving or the use of certain equipment where safety requires it.
- Any damage to the yacht, its tender, equipment or fittings caused by a guest is charged to the client after the charter
- Guests are responsible for their own belongings brought on board; we do not accept liability for items lost, left behind or damaged during the charter
- Any loss required to be reported under maritime or port regulations, such as an item lost overboard, will be reported by the crew
10. Liability and complaints
Our liability relates to the proper performance of the charter service itself. We are not liable for indirect loss, for delays caused by weather, port authorities or technical issues outside our control, or for the acts of guests themselves. Nothing in these terms limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence.
Any complaint about a charter should be sent to [email protected] as soon as possible, together with the booking details and a description of the issue. We will review the matter and respond in writing.
11. Website content, governing law and updates
The text, images, yacht descriptions and layout of unanocheenlamovida.es belong to Ibiza charter yachts or to parties who have licensed them to us and may not be copied or reused without permission. Information on the site, including prices and availability, is provided in good faith and may be updated at any time; it only forms part of a booking if it is repeated in the written quote.
These terms are governed by Spanish law. Any dispute arising from a booking made through unanocheenlamovida.es that cannot be resolved directly between the parties will be submitted to the courts of Spain with jurisdiction over Ibiza, without prejudice to any mandatory consumer forum that applies to the client.
We may update these terms as our services evolve; the version published on the site at the moment a quote is accepted is the one that governs that particular booking.
